In criminal law, the defense of mistake involves situations where an individual commits a crime but genuinely and reasonably believes their actions are lawful. Mistake can be either of fact or law. Mistake of fact occurs when a person is unaware of a circumstance that makes their actions criminal. If the mistake is reasonable and genuine, it may serve as a defense, especially in strict liability offenses. However, mistake of law generally doesn't excuse criminal conduct. Courts consider the reasonableness of the mistake, emphasizing that ignorance of the law is not a valid defense. The law of mistake aims to balance culpability with the accused's honest and reasonable beliefs.
