The 1988 constitutional amendments had the effect of inserting Article 121 (1A) into the Federal Constitution. Contrast briefly the attitude of the Supreme Court in Che Omar bin Che Soh v Public Prosecutor [1988] 2 MLJ 55 and that of the Federal Court in Soon Singh a/l Bikar Singh v Pertubuhan Kebajikan Islam Malaysia (PERKIM) Kedah & Anor [1999] 1 MLJ 489. The Soon Singh position is most recently affirmed in Kaliammal a/p Sinnasamy v Majlis Agama Islam Wilayah Persekutuan (JAWI) & Ors. [2012] 3 MLJ 694.
