‘What rescuer ever thinks of his own safety? It seems to me that it would be very artificial and unnecessary control to say a rescuer can only recover if he was in fact in physical danger. A danger to which he probably never gave thought, and which in any event might not cause physical injury . . . I do not share the view that the public would find it in some way offensive that those who suffered disabling psychiatric illness as a result of their efforts to rescue the victims should receive compensation.’ (Lord Griffiths, White v Chief Constable of South Yorkshire [1999] 2 AC 455 at 465) In view of this statement, evaluate the position of a rescuer in a claim for psychiatric injury and whether the law is at a justifiable position.
