Loielo v Giles1 is a case between the plantiff Michelle Loielo and the defendant Associate Professor Michelle Giles around the issue where Giles’ exercised emergency powers in her capacity as Deputy Public Health Commander during greater Melbourne’s second wave of COVID-19 pandemic lockdown in September 2020. Loielo challenged the jurisdictional validity of Giles’ decision in imposing the curfew against Public Health and Wellbeing Act 2008 (Vic) 2 and Charter of Human Rights and Responsibilities Act 2006.The Supreme Court of Victoria dismissed the application by Loielo after undergoing a comprehensive judicial review and analysis
