Following British colonisation of Australia in1788, the system of Common Law first developed in England, was adopted as part of Australian law. According to Paul Latimer’s ‘Australian Business Law’ common law “ is made handed down, written) by judges in courts.” Common law was developed during the eleventh century in the Royal Courts of England, when the English monarchs sent circuit judges to conveyance courts from region to region, hearing cases and ultimately judges began to follow former decisions making them gradually more consistent.
