Human rights notes for week 12 for public law. • Human rights are entitlements which every person is said to have a claim to simply by virtue of being human. • Loius Henkin (in The Age of Rights) (Columbia University Press, 1990) says: • They are those benefits deemed essential for individual well-being, dignity and fulfilment and that reflect a common sense of justice, fairness and decency. • “Human rights are rights of individuals in society…they are defined, particular claims” • Human rights include not only NEGATIVE “immunity claims” but also POSITIVE “resource claims,” claims to what society is deemed required to do for the individual
