T1 2016 MLL 319 Proportionality Assignment. For Retributivists, punishment is justified by a morally deserving proportionate punishment , which must be in a manner that is just in all the circumstances . For the justification of consequentialism, it looks forwards to the future for the crime. The ‘good’ effects that derive from the punishment can vary but are expressed in the Sentencing Act 1991 (Vic) as deterrence of the same or similar offences , rehabilitation of the offender and can also include the protection of the community from the offender .
